This Terms and Conditions between you and Xacom Pty Ltd.
This agreement applies to you when using our site shop.xacom.com.au.

Placing Orders
When placing an order, you must review it carefully. You are unable to cancel or change it once order is placed. You are responsible for all orders placed on your account including errors in your order caused by you. We are unable to accept the product for refund or exchange if you simply made an incorrect purchase or change your mind.

Shipping and Delivery
We endeavor to ship products same day or next business day of payment being cleared.
Please allow up to 3 – 10 business days for delivery. Delivery times are estimates only. All deliveries are track and traceable. During peak periods, our carriers may delay beyond our control.

Returns
If you have a problem with your item, please contact us. We will investigate the issue and advise whether you may return the item for refund, repair, or exchange. We will make a decision on your dispute in accordance with our returns policies. If we believe the item was not used in accordance with manufacturer’s instructions, failure to take reasonable care or the item have been misused, we may reject the dispute and return your item to you.

This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from shop.xacom.com.au.
Personal information we collect
When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. Additionally when you make a purchase or attempt to make a purchase through the Site, we collect certain information from you, including your name, billing address, shipping address, payment information, email address, and phone number. We refer to this information as “Order Information”.
When we talk about “Personal Information” in this Privacy Policy, we are talking both about Device Information and Order Information.
How do we use your personal information?
We use the Order Information that we collect generally to fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). Additionally, we use this Order Information to:

Do not track
Please note that we do not alter our Site’s data collection and use practices when we see a Do Not Track signal from your browser.
Data retention
When you place an order through the Site, we will maintain your Order Information for our records unless and until you ask us to delete this information.
Changes
We may update this privacy policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons.
Minors
The Site is not intended for individuals under the age of 18.

Warranty and Returns
Subject to the terms and conditions set out below, Xacom agree to repair or replace the product which it supplied to you at its own cost, in circumstances where the Product does not perform in accordance with Xacom specifications during the Standard Care Warranty period.

The benefits provided to you by this contractual product warranty are in addition to other rights and remedies available to you under the law.
Proof of purchase must be provided when requesting service under the Standard Care Warranty.
Xacom requires any customer requesting service under the Standard Care Warranty to comply with directions from Xacom staff in relation to troubleshooting any issue and facilitating any repair or replacement under these Warranty Terms and Conditions.
Xacom reserves the right to replace the Product or relevant part with the same or equivalent Product or part, rather than repair it. If Xacom is unable to repair or replace the Product, the customer will be provided a refund of the price of the Product
The Customer is responsible to inspect all goods received from Xacom upon arrival. In instances where goods have been damaged in transit, the Customer must report this to Xacom within 2 days of receipt of the product. Failure to report physical damage on arrival within 2 days of receipt may result in denial of warranty for physical damage
Warranty do not apply if the following occur:

To consumable parts, such as batteries or protective coatings that are designed to diminish over time, unless failure has occurred due to a defect in materials or workmanship;

Cosmetic damage, to boxes, packaging or exterior surfaces (including during transit);
-
Damage caused by use with another product;
-
Damage caused by accident, abuse, misuse, liquid contact, fire, earthquake or other external cause;

Damage caused by operating the Product outside any guidelines published for use;

Damage caused by service (including upgrades and expansions) performed by anyone who is not a representative of Xacom;
-
A Product that has been modified to alter functionality or capability without the written permission of Xacom, including but not limited to installation of custom firmware or other software;

Defects caused by normal wear and tear or otherwise due to the normal ageing of the Product,
-
If any serial number has been removed or defaced from the Product,
-
If the product is stolen or Xacom reasonably believes that the product is stolen based on information provided by law enforcement authorities, or
-
Where proof of purchase (invoice or paid Order confirmation) cannot be provided.

If Repairs are carried out by a third party or the phone has been opened or tampered with.
The Product will be at the Customer's risk while in transit to and from Xacom’s Authorised Repair Centre.
Xacom may seek reimbursement of any costs incurred by Us where the Product is found to be in good working order, or when it has been determined that the Standard Care Warranty does not apply.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if goods fail to be of acceptable quality and the failure does not amount to a major failure.
